Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Every Life Tribute (“we,” “us,” or “our”), including our website, applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

If you are using the Service on behalf of a funeral home or organization, you represent that you have authority to bind that organization to these Terms.

Every Life Tribute helps funeral directors and families create, collaborate on, and display memorial photo presentations. Features may include photo uploads, slide editing, family invitations, chapel display pairing, guest photo contributions, and subscription billing per location.

We may update, add, or remove features from time to time. We will make reasonable efforts to avoid disrupting active memorial services, but the Service is provided on an evolving basis.

Funeral directors and staff may register organization accounts. Directors may invite family collaborators to specific memorials. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You agree to provide accurate registration information and to notify us promptly of unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

You agree not to:

• Upload content you do not have the right to use or share
• Upload unlawful, abusive, or infringing material
• Attempt to access another organization's data without authorization
• Interfere with the Service, display devices, or other users' experience
• Circumvent billing, authentication, or security controls

Funeral directors are responsible for reviewing family-submitted and guest-contributed content before it is shown in a service or on a display.

You retain ownership of photos, music, text, and other materials you upload (“Your Content”). You grant us a limited license to host, process, display, and transmit Your Content solely to operate the Service — including generating presentations, enabling collaboration, and delivering content to paired display devices.

You represent that you have obtained all necessary rights and consents for Your Content, including from family members and estates where applicable.

Paid features may be offered on a per-location subscription basis through our payment processor (currently Stripe). Fees, billing cycles, and trial terms are presented at checkout or in your account settings.

Subscriptions renew automatically unless canceled before the renewal date. You may manage billing through the customer portal we provide. Fees are non-refundable except where required by law or explicitly stated otherwise.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted access, error-free operation, or that the Service will meet every funeral home's technical or ceremonial requirements. You are responsible for verifying presentations before a service.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim or (b) one hundred U.S. dollars ($100).

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends, but sections that by their nature should survive will remain in effect.

We may revise these Terms from time to time. If changes are material, we will provide notice through the Service or by other reasonable means. Continued use after the effective date constitutes acceptance of the revised Terms.
